1. Agreement to Terms

By accessing or using the services provided by Digital Niche Agency ("DNA," "we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.

2. Services Description

Digital Niche Agency provides digital marketing services specifically designed for MedSpas and aesthetic practices. Our services include but are not limited to:

• Paid advertising campaign management on Meta (Facebook/Instagram) and Google platforms
• Lead generation and appointment setting services
• Custom landing page creation
• Marketing consultation and strategy

3. Client Guarantee

Our pay-per-client model guarantees a specific number of booked appointments per month based on your selected package (Starter: 10 clients, Growth: 20 clients, Scale: 30 clients). A "client" is defined as a qualified lead who has booked an appointment at your MedSpa.

If we do not meet the guaranteed client count within a billing cycle, we will continue working at no additional cost until the target is reached, or provide a pro-rated credit toward the next billing cycle.

4. Payment Terms

All packages are billed monthly and auto-renew until cancelled. Payment is due at the beginning of each billing cycle. We accept major credit cards and offer Buy Now, Pay Later options through Klarna for eligible customers.

Prices are subject to change with 30 days written notice. Any price changes will not affect current billing cycles.

5. Cancellation Policy

You may cancel your subscription at any time with 30 days written notice. Cancellation requests must be submitted via email to [email protected]. Upon cancellation:

• Your service will continue until the end of the current billing cycle
• No refunds will be issued for partial months
• Any outstanding client guarantees will be fulfilled before service termination

6. Client Responsibilities

To ensure successful campaign performance, clients agree to:

• Provide accurate business information and marketing assets
• Respond to leads and booked appointments in a timely manner
• Maintain active and accurate calendar availability
• Comply with all applicable laws and regulations regarding their services
• Not engage in false or misleading advertising

7. Intellectual Property

All marketing materials, ad creatives, landing pages, and other content created by DNA remain the intellectual property of Digital Niche Agency unless otherwise agreed in writing. Clients are granted a license to use these materials for the duration of their service agreement.

8. Limitation of Liability

Digital Niche Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you for services in the three months preceding the claim.

9. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new terms.
